IMPORTANT: Freudly.ai is not a healthcare provider and does not provide licensed psychotherapy, counseling, diagnosis, or treatment. Use of the Service does not create medical or clinical relationships. Freudly.ai is not a substitute for professional care. Nothing stated, published, or made available through Freudly.ai constitutes or should be construed as the practice of medicine or the provision of medical care.
1. Introduction and Acceptance of Terms
Welcome to Freudly.ai!
These Terms of Use (“Terms”) are a legal agreement between you and the Freudly.ai service (“Freudly.ai,” “we,” “us”). By downloading, installing, opening, and using the Freudly.ai mobile application or web platform (the “App” and the “Platform”), you agree to comply with these Terms. If you do not agree, do not use Freudly.ai.
Freudly.ai is an AI-powered platform designed to provide informational support and self-reflection tools. Freudly.ai is not a medical or therapeutic service and does not replace professional care.
The minimum age of use is 18 years. If you are under 18, do not use the App or Platform.
“Inputs” are the words, messages, or content you enter or upload to the App/Platform.
“Outputs” are the responses, messages, or content generated by Freudly.ai’s AI in response to your Inputs.
2. Service Description and Limitations
Freudly.ai is not a healthcare provider and does not provide licensed therapy, counseling, diagnosis, or treatment. No medical/clinical relationship is created. Freudly.ai is an AI-based tool offering general support, information, and means for self-reflection. It is not a medical device, does not act as a licensed therapist or physician, and does not provide therapy, counseling, diagnosis, or treatment of any kind.
The App and Platform are not a substitute for professional therapy, counseling, or medical advice. In the event of a crisis or the need for psychiatric/psychological assistance, contact a licensed professional or emergency services.
The Service operates on AI. Outputs may be inaccurate, incomplete, or unsuitable for your situation. Freudly.ai is not regulated under HIPAA and is not intended for sharing Protected Health Information (PHI) or other sensitive medical data.
These Terms govern your use of Freudly.ai. If you use the Service through an organization (e.g., school or employer), that organization’s agreement with Freudly.ai may also apply.
3. User Eligibility and Account Creation
To use the App or Platform, you must be at least 18 years old and legally capable of entering into a contract. By using Freudly.ai, you confirm that:
- Freudly.ai is not a healthcare provider, licensed therapist, or counselor;
- no doctor–patient relationship is created;
- Freudly.ai is not a substitute for professional care;
- all decisions about diagnosis, treatment, or care are made by you and your provider.
When creating an account, you may provide, among other things: your name, email address, mobile phone number, social media account, and a password. If accessing through an organization, you may use a special code or corporate email. You are responsible for keeping your data accurate and your password secure. Your account may not be transferred to third parties.
By using Freudly.ai, you agree to these Terms and our Privacy Policy.
4. Acceptable Use Policy (AUP)
When using the App or Platform, you agree to:
- use Freudly.ai only for personal, non-commercial purposes;
- keep account data up to date and protect your password; you are responsible for all activity in your account;
- not share access to and not allow others to use your account;
- not use the Service for unlawful, harmful, or fraudulent purposes;
- not upload/transmit defamatory, obscene, offensive, privacy-infringing, or otherwise unacceptable content;
- not attempt to decompile, reverse-engineer, copy, or misuse Freudly.ai technologies/AI systems;
- not transmit PHI, regulated health data, or other sensitive medical information;
- comply with the Freudly.ai Privacy Policy (incorporated by reference);
- not violate these Terms, the Privacy Policy, or applicable law;
- if accessing through an organization, follow its additional rules/onboarding;
- not use the Service to discuss, seek advice for, or disclose (“Prohibited Topics”):
i) escalating obsession with another person;
ii) isolation, stalking, threats disguised as concern/love;
iii) emotional dysregulation, loss of connection with reality;
iv) suicidal thoughts, ideation, plans, or actions;
v) psychosis and/or extremely pronounced paranoia (e.g., “the voices tell me…,” “I know they are watching me…”);
vi) self-neglect to the extent of risk of bodily harm;
vii) cumulative/escalating behaviors indicating danger;
viii) other topics prohibited by law in the place where the app/service is used within the scope of counseling and/or AI counseling;
ix) discussion of medical procedures and interventions (surgery, taking medications, abortion, etc.).
If you discuss the above, Freudly.ai may immediately suspend/terminate access and direct you to licensed professionals or emergency services. The Service is not intended for such situations.
You are responsible for your own actions and the content you share. You are responsible for your Inputs and for any use of the Outputs. If you violate the Terms, Freudly.ai may suspend/terminate access and/or remove content that violates policies or indicates the need for professional care.
5. Data Ownership and Privacy
You retain rights to the Inputs you submit (messages, questions, preferences). Freudly.ai’s AI generates Outputs based on your Inputs. By using the Service, you grant us permission to use, process, and analyze your Inputs and Outputs to provide, support, and improve the Service, including AI training, analytics, and product development.
Freudly.ai may create anonymized and aggregated data from Inputs/Outputs for research, analytics, and improvement of AI systems. Such data does not personally identify you.
If you use the Service through an organization (school/employer), that organization may provide Freudly.ai with some of your data (name, email, etc.) to set up your account. This data (“Customer Data”) is managed by the organization and governed by our Data Processing Agreement (DPA).
Your privacy matters. Details are in the Privacy Policy. Freudly.ai may disclose personal information as required by law, regulator, subpoena, or government request.
6. Intellectual Property and Outputs
Freudly.ai owns all rights in the App/Platform and the technologies that power them.
You own the content (Inputs) you post, provided you have the rights to it. The AI generates Outputs based on your Inputs. By using the Service, you grant us permission to store and analyze Inputs/Outputs to provide and improve the Service, including AI training and analytics. You confirm that you have the right to upload/share any content. If the content belongs to a third party and you lack permission, do not upload it.
You may view, copy, or download your Outputs through the App/Platform. To export/delete, use in-app tools or write to support@freudly.ai.
Freudly.ai may use anonymized and aggregated Outputs to improve AI models, develop features, and for analytics and research.
You may use Outputs for personal, non-commercial purposes. You may not sell, publish, or use Outputs for commercial purposes without Freudly.ai’s written consent. If you believe an Output contains an error or inappropriate content, contact support@freudly.ai.
7. AI Disclaimer (Hallucinations, Inaccuracies)
Freudly.ai is not a healthcare provider and does not provide licensed therapy, diagnosis, or treatment. The Service is AI-based; responses may be inaccurate, incomplete, or inappropriate (“hallucinations”). Do not rely on Outputs for important decisions, emergencies, or issues of health/safety/well-being. The Service is not a substitute for professional advice, therapy, or medical care.
You are responsible for how you use Outputs. In case of serious concerns or crisis, contact a professional or emergency services.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Freudly.ai provides the App and Platform “AS IS” and “AS AVAILABLE”. Freudly.ai and its affiliates, officers, employees, agents, and contractors make no warranties (express or implied), including fitness for a particular purpose, non-infringement, availability, security, accuracy, or reliability. We do not warrant uninterrupted operation, error-free performance, security, or defect correction.
Freudly.ai does not provide medical, mental-health, or licensed therapeutic advice/diagnoses. Nothing in the App/Platform constitutes the practice of medicine or provision of medical care.
To the fullest extent permitted by law, Freudly.ai and related parties are not liable for indirect, incidental, punitive, or special damages (including lost profits, data loss, loss of goodwill, personal injury, property damage, unauthorized disclosure), regardless of the theory (contract, tort, strict liability, etc.), even if advised of the possibility.
The aggregate liability of Freudly.ai to you does not exceed USD $100 or the equivalent in another currency.
You are responsible for your actions, decisions, and reliance on any Outputs/information of the Service. If in doubt, consult a qualified professional.
Some jurisdictions do not allow certain exclusions/limitations; such provisions apply to the maximum extent permitted.
9. Indemnification
You agree to indemnify, defend, and hold harmless Freudly.ai, its affiliates, officers, employees, agents, and contractors from any third-party claims/demands/losses/expenses (including reasonable attorneys’ fees) arising out of or related to:
- your use of the App/Platform;
- Inputs/Outputs/content you submit/share;
- your violation of the Terms/Policy/law;
- your violation of third-party rights (IP, privacy, publicity);
- your gross negligence/willful misconduct/fraud.
This does not apply to claims caused solely by Freudly.ai’s gross negligence or willful misconduct.
10. Suspension and Termination
Freudly.ai may suspend/terminate your access if:
- you discuss Prohibited Topics (Section 4.11.i–ix);
- in our discretion, your case requires intervention by a licensed professional/emergency services;
- you violate the Terms, cause harm to yourself/others/the Service, or fraudulent/illegal activity is detected.
Upon suspension/deletion, you may lose access to your account and data (Inputs/Outputs). Freudly.ai is not responsible for such loss. If terminated for violations, we may retain certain information as required by law or for legitimate business purposes.
You may stop using the Service at any time by deleting your account or the App. For account/Inputs/Outputs deletion and data questions, contact support@freudly.ai.
11. Dispute Resolution and Governing Law
11.1. Informal Resolution. Contact support@freudly.ai first - we will try to resolve the dispute informally within 30 days.
11.2. Consumers in the EEA/UK/Switzerland. If you are a consumer habitually resident in a country of the European Economic Area, the United Kingdom, or Switzerland, you may bring claims in the courts of your country of residence, and you are afforded the mandatory consumer protection laws of your country. Nothing in these Terms deprives you of those protections. The choice of law in Section 11.4 applies only to the extent it does not deprive you of such guarantees.
11.3. Other Users and B2B. For users acting not as consumers (including legal entities, sole proprietors, and individuals using the Service for professional/business purposes), any disputes arising from these Terms or the Service are subject to binding arbitration administered by JAMS under the JAMS Rules. Seat of arbitration: Los Angeles, California, USA; language: English. The award is final and enforceable. The parties waive jury trial and class actions. Courts of the State of California or the U.S. federal court located in Los Angeles County have jurisdiction to recognize/enter judgment on the award.
11.4. Governing Law.
- For disputes under Section 11.3 (B2B/non-consumer): the laws of the State of Delaware, USA, excluding conflict-of-laws rules, apply.
- For consumers (Sections 11.2): this choice of law does not deprive you of the protection of mandatory rules of the country of your habitual residence; those rules prevail. Otherwise, Delaware law applies to the extent permitted.
11.5. Severability. If any provision of Section 11 is found invalid or unenforceable in your jurisdiction, the remainder remains effective; the affected part is deemed modified to the minimum extent necessary to comply with applicable law.
11.6. EU Online Dispute Resolution Platform. If you reside in the EU, you may also use the European Commission’s ODR platform for out-of-court consumer dispute resolution. This does not limit your right to bring an action in the courts of your residence.
12. Changes to the Terms
We may update the Terms. In case of changes, we will post the updated version on the App/Platform. By continuing to use the Service after publication, you agree to the updates. If you disagree, stop using the Service and delete your account.
13. Notices and Communications
Questions and support: support@freudly.ai. We may send notices by email, through the App, or via the Platform. Keep your contact information current.

14. Miscellaneous
Assignment: you may not transfer your rights/obligations under the Terms without Freudly.ai’s written consent. We may transfer rights/obligations as part of a transaction (merger/sale).
Severability: invalidity of part of the Terms does not affect the remainder.
No Waiver: our failure to enforce a right is not a waiver of that right.
Survival: provisions that by their nature should survive termination remain in force after use ends.
No Third-Party Beneficiaries: these Terms are only between you and Freudly.ai.
