Introduction and Overview

At Freudly.ai, we care about your privacy. This Policy explains how we collect, use, share, and protect information when you:

  • use the Freudly.ai App/Platform as a User;
  • visit freudly.ai;
  • register for/participate in Freudly.ai webinars, events, or marketing activities;
  • interact with marketing communications;
  • otherwise share personal information with Freudly.ai.

This Policy applies where Freudly.ai acts as a Data Controller (under applicable privacy laws) in our direct relationship with individual users. If you access Freudly.ai through an organization (a “Customer”), our role as Data Processor is governed by a Data Processing Agreement (DPA) with that Customer.

By using Freudly.ai, you acknowledge this Policy and agree to the practices described.

Freudly.ai does not replace professional care, licensed therapy, or crisis support. Users must not use Freudly.ai for Prohibited Topics (see the Terms). If such topics are discussed, access may be suspended/terminated and you may be directed to licensed professionals/emergency services.

Definitions:

  • Inputs: words, messages, or content you enter/upload to the App, Platform, or website.
  • Outputs: responses/content generated by Freudly.ai’s AI in response to Inputs.
  • User Data: all Inputs, Outputs, and other information you provide directly as an individual user.
  • Customer Data: information provided by organizations to set up and manage your account (name, email, admin data). Customer Data is governed by our DPA, not this Policy.

Important: Freudly.ai is not a HIPAA-covered entity and does not provide medical/clinical services. Please do not include PHI or sensitive medical information in your interactions with the Service.

Information We Collect

User Data (Inputs and Outputs)

  • Inputs: your messages/content (questions, notes, requests).
  • Outputs: responses from Freudly.ai’s AI.
  • Conversation Data: the content of your interactions (Inputs + Outputs).

Account and Profile Data:

  • Account: name, email, phone (optional), and payment data when subscribing.

Service Usage and Device

  • Data Usage Data: features used, session duration, frequency, engagement.
  • Device Information: device type, OS, browser, IP, identifiers.

Website Visitors and Marketing

  • Web Analytics: interactions with our website and emails (IP, browser, device, engagement).

How We Use Information

Service Provision and Improvement

  • Generate personalized Outputs in response to Inputs.
  • Analyze Inputs/Outputs/usage patterns for personalization.
  • Train/develop AI models using anonymized and aggregated data (Inputs/Outputs) to improve quality.
  • Create and use synthetic data derived from anonymized interactions.
  • Generate aggregated insights to enhance support.

Account Management

  • Create and maintain your account.
  • Process subscriptions and billing.
  • Communicate about your account, service updates, and provide support.
  • Provide technical support and respond to inquiries.

Website and Marketing

  • Operate and improve our website and communications.
  • Send marketing emails/invitations (with your consent).
  • Understand how visitors engage with the site/content.

Legal and Security

  • Protect the security and integrity of the Service.
  • Detect and prevent fraud.
  • Comply with legal obligations.
  • Enforce our Terms, AUP, and Prohibited Topics. Accounts may be suspended/removed and content deleted upon violations.

Disclosure of Information

We treat your information confidentially and do not sell personal data. Disclosures may occur in the following cases:

Service Providers (Sub-processors)

Cloud hosting, payment processors, analytics, support tools, etc. All sub-processors are contractually required to use data only to provide services to Freudly.ai and comply with privacy laws.

Business Transactions

In case of merger/acquisition/sale of assets, information may be transferred to a successor. We will notify you by email and/or a notice on our website.

Legal Requirements and Safety

We may disclose information as required by law/court/authority, or if we believe it necessary to protect rights, address fraud, or ensure safety.

Your Privacy Rights

Rights vary by jurisdiction, but generally you can:

  • access your information;
  • update/correct inaccuracies;
  • request deletion of your account and personal data;
  • opt out of marketing communications;
  • download Inputs/Outputs (where available);
  • request deletion of Inputs/Outputs (where available).

EU/UK/Switzerland (GDPR)

Rights to access, rectification, erasure (“right to be forgotten”), restriction/object to processing, portability, withdrawal of consent, and complaint to a supervisory authority. Applies to your Inputs/Outputs/User Data. Requests: privacy@freudly.ai.

California (CCPA/CPRA)

Right to know/delete/not be discriminated against for exercising rights. We do not sell personal data and do not share Inputs/Outputs with third parties for advertising. Requests: privacy@freudly.ai. (If you use the Service through an organization, some information may be administered by that organization.)

Other U.S. States with Comprehensive Laws

Similar rights to access/delete/correct and opt out of certain processing.

Canada (PIPEDA)

Rights to access, challenge accuracy, provide/withdraw consent. Requests: privacy@freudly.ai.

Brazil (LGPD)

Rights similar to GDPR (access, correction, anonymization, deletion, information about sharing practices).

China (PIPL)

Rights to access/copy, correction/addition, deletion in certain cases, explanation of processing rules, withdrawal of consent.


Data Retention and Deletion

Account Data

We retain your account data while your account is active. After termination/cancellation, we delete personal data within 30 days. If your account is through an organization, certain Customer Data may be retained under the agreement with that organization.

Conversation Data

  • Active users: conversation history is retained to provide personalization.
  • After account deletion: conversations are deleted within 30 days (exceptions: legal/legitimate interests, including legal defense/compliance).
  • You can delete specific conversations via the App (where available).
  • Conversation Data includes your Inputs and the Outputs.

Anonymized and Aggregated Data

We may retain such data indefinitely. Such data does not allow personal identification and is used for improvements, research, and analytics.

Usage Data

Basic usage statistics may be retained for up to 24 months, then fully anonymized or deleted. Anonymized usage patterns may be retained indefinitely.

Jurisdiction-Specific Requirements

  • EU/UK/Switzerland: in accordance with GDPR.
  • Other jurisdictions: local retention requirements apply.

Deletion Process

Upon deletion:

  • personal data is removed from active systems;
  • backups are cycled out within 90 days;
  • anonymized derivatives (including from Inputs/Outputs) may be retained.

Requesting deletion: via in-app tools, by emailing privacy@freudly.ai, or by deleting your account.

Security

Technical measures: encryption in transit and at rest, regular assessments/penetration testing, access controls, monitoring.

Organizational measures: staff training, background checks for staff with access, security policies, incident response plan.

Third-party assessments: regular external audits/reviews, compliance verification, vendor security reviews.

Breach notification: we will notify you in accordance with applicable law and provide information and guidance.

International Data Transfers

We are a global service - data may be processed outside your country.

Mechanisms: for EU/UK/Switzerland - Standard Contractual Clauses (SCCs); for other jurisdictions - appropriate safeguards.

Data localization: we comply with local storage requirements where mandated.

Safeguards: encryption, access controls, contractual obligations from providers, regular assessment of cross-border transfer risks.

Changes to this Policy

We may update this Policy periodically. Material changes  - we will notify by email or through the Service; the updated version with a new “Last Updated” date will be posted on the site/in the App. By continuing to use the Service after changes, you accept the updated Policy. For material changes, we may seek renewed consent.

Important Information About Our Service

Non-medical nature:

  • Freudly.ai is an AI chat for support, not medical advice or clinical therapy;
  • our AI is not a licensed therapist/physician;
  • the Service does not replace professional care;
  • conversations are processed automatically by AI, without routine human review (except in limited cases for service improvement).

Automated Processing:

  • the Service operates predominantly automatically;
  • we do not routinely review individual conversations;
  • systems may analyze conversations to improve responses and functionality;
  • rare human review occurs on anonymized/aggregated datasets.

Data Sensitivity:

  • we account for the sensitivity of content and apply appropriate safeguards;
  • such data is generally not “medical data” under most regulations.

Refunds

We want your experience to be positive. If you are not satisfied, we provide a full refund within 48 hours of purchase - no questions asked.

Conditions:

  • the request must be made within 48 hours of purchase;
  • applies to first-time purchase only (not renewals);
  • in cases of intensive use within that period, refunds may be evaluated case-by-case.

How to request: email support@freudly.ai with the subject “Refund Request” and include the email used for your account. After 48 hours, all purchases are final.
